Accused gang leader turns himself in at Remand Centre

CALGARY (660 NEWS) – Police have confirmed Nick Chan is back in custody.

The accused gang leader was ordered back in custody Tuesday after the Alberta Court of Appeal ordered a new trial for Chan.

Chan is to stand trail for first degree murder in the 2008 death of a rival gang member.

In April, a trial judge ruled Chan’s charter rights were violated because the crown took too long to bring the matter to trail.

But the Court of Appeal overruled that, arguing the delay was reasonable because of the complexity of the case.

Chan has been acquitted on two previous occasions on organized crime allegations, including a shooting at the Bolsa restaurant on New Years Day 2009, that killed three people including innocent bystander Kenny Sua.
