Crown appeals accused gangster's release

Crown prosecutors want a new trial for an alleged Calgary gangster who walked free Tuesday after charges of first degree murder and other counts were thrown out.

Alberta Justice confirmed Wednesday that the Crown filed a notice of appeal in the Nick Chan case, after a judge stayed charges because Chan’s right to a be tried within a reasonable time had been violated.

Chan was charged in the shooting death of Nick Anaya in 2008 and also faced counts of conspiracy to commit murder and instructing a criminal organization.

He was previously acquitted of first degree murder in the January 2009 Bolsa Restaurant shooting, which ended in the deaths of three people.
